General Terms and Conditions of Sale

Preamble

These general terms and conditions of sale apply to all sales concluded on the website www.amenolia.com.

AMENOLIA is a simplified joint-stock company with a share capital of 1,000 euros, whose registered office is located at 23 chemin des Cannes in Castillon-du-Gard (30210), registered with the Nîmes Trade and Companies Register under number 979 690 443 and VAT number FR53979690443.

AMENOLIA declares that it fulfills its obligations under extended producer responsibility for the sector covered by this identifier, in accordance with Article R.541-173 of the French Environmental Code. This identifier is provided to any buyer upon request sent to sav@amenolia.com.

Unique EPR identifier (household packaging sector), issued by ADEME: FR539427_01EQKV.

Article 1 – Principles

These general terms and conditions express the entirety of the parties' obligations. In this respect, the buyer is deemed to accept them without reservation. They are available on the amenolia.com website and shall prevail, where applicable, over any other version or any other conflicting document.

AMENOLIA and the buyer agree that these general terms and conditions exclusively govern their relationship. AMENOLIA reserves the right to modify its general terms and conditions at any time by publishing a new version on its website.

The general terms and conditions applicable to the order are those in force at the time the order is placed.

By checking the box relating to the acceptance of the general terms and conditions when placing the order and/or creating a customer account, the customer declares that they have read, understood, and accepted the general terms and conditions without reservation.

Capacity

The buyer declares that they are an adult natural person with the legal capacity to enter into contracts, acting for purposes that do not fall within the scope of their commercial, industrial, artisanal, liberal, or agricultural activity. These general terms and conditions apply exclusively to sales concluded with consumers within the meaning of the introductory article of the French Consumer Code.

Durable medium

These general terms and conditions are permanently available on the website and can be downloaded and printed. A copy of the general terms and conditions in force on the day the order is placed is sent to the buyer on a durable medium, as an attachment or via a permanent link in the order confirmation email, in accordance with Article L.221-13 of the French Consumer Code.

Modification

Changes to the general terms and conditions only apply to orders placed after they are published online. They are in no way binding on orders already confirmed.

Evidence

Computerized records kept in AMENOLIA's systems under reasonable security conditions are considered evidence of communications, orders, and payments between the parties, without this clause preventing the buyer from providing evidence to the contrary by any means.

Article 2 – Content

The purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by AMENOLIA to the buyer from the website www.amenolia.com.

These terms and conditions only concern purchases made on the AMENOLIA website. These purchases concern the following products: clothing and fashion accessories.

Delivery area

These general terms and conditions apply to deliveries made in mainland France, Corsica, the French overseas departments and territories, Switzerland, and the European Union Member States expressly listed in Article 9. Any order placed from a country not served cannot be fulfilled.

Deliveries outside the European Union (Switzerland, certain overseas territories)

The displayed prices exclude customs duties and local taxes. Any customs duties, import taxes, local VAT, and customs clearance fees are payable upon arrival and remain entirely the responsibility of the buyer, who is encouraged to inquire with the authorities in their country before ordering. Refusal to pay these fees resulting in the return of the package is subject to Article 11.4.

Article 3 – Pre-contractual information

The buyer acknowledges having received, prior to placing their order and concluding the contract, these general terms and conditions of sale in a clear and understandable manner.

The following information is provided to the buyer in a clear and understandable manner:

  • The essential characteristics of the goods.
  • The price of the goods and/or the method of calculating the price.
  • If applicable, all additional transport, delivery, or postage costs and all other fees payable.
  • In the absence of immediate performance of the contract, the date or timeframe by which AMENOLIA undertakes to deliver the goods, regardless of their price.
  • Information relating to the seller's identity, postal, telephone, and electronic contact details, and their activities; information relating to legal warranties, the functionalities of digital content and, if applicable, its interoperability; the existence and terms of implementation of warranties and other contractual conditions.
  • The conditions, timeframe, and procedures for exercising the right of withdrawal, as well as the standard withdrawal form.
  • The fact that the costs of returning the goods in the event of withdrawal are borne by the buyer.
  • The procedures for handling complaints, as described in Article 11 and Article 17.
  • The possibility of free recourse to a consumer mediator, whose contact details are provided in Article 17.
  • A reminder of the existence and terms of implementation of the legal warranty of conformity and the legal warranty against hidden defects, reproduced in the box in Article 12.3 of the general terms and conditions.
  • The accepted payment methods and any delivery restrictions, indicated at the latest at the beginning of the ordering process.

Article 4 – The order

The buyer has the option to place their order online, using the online catalog and the form provided there, for any product, subject to available stock.

The buyer will be informed of any unavailability of the ordered product or goods.

For the order to be confirmed, the buyer must accept these general terms and conditions by clicking in the indicated area. They must also choose the delivery address and method, and finally confirm the payment method.

The sale will be considered final after the buyer receives the seller's confirmation of acceptance of the order by email.

Any order constitutes acceptance of the prices and the description of the products available for sale. Any dispute on this point shall be subject to any potential exchange and the warranties mentioned below.

Orders are prepared from Monday to Friday, between 9 a.m. and 5 p.m., excluding weekends, public holidays, and closure periods.

In certain cases, notably in the event of non-payment, an incorrect address, or another issue with the buyer's account, AMENOLIA reserves the right to block the buyer's order until the issue is resolved.

Contract conclusion steps

The order follows these steps: selection of products and addition to the cart; viewing the summary cart allowing the buyer to check the details of their order and its total price and, if applicable, correct any errors before confirmation, in accordance with Article 1127-2 of the French Civil Code; identification or account creation; choice of delivery address and method; express acceptance of these general terms and conditions; choice of payment method; final confirmation by clicking on a button bearing the words "pay now", in accordance with Article L.221-14 of the French Consumer Code; payment; receipt of an electronic acknowledgment of receipt summarizing the order.

The buyer may at any time, before final confirmation, return to previous steps, modify the contents of their cart, or abandon their order.

For any questions regarding order tracking, the buyer may write to sav@amenolia.com.

Article 4.1 – Right of cancellation and order refusal

AMENOLIA reserves the right not to process an order if it comes from a customer who has already been subject to a dispute related to the payment of a previous order or who does not comply with the current general terms and conditions of sale.

In the event of returns deemed abnormally high, AMENOLIA also reserves the right to refuse to process any future order from the customer concerned.

AMENOLIA may also refuse to confirm an order in the event of a technical malfunction on the website, such as an incorrect display of prices or available quantities. AMENOLIA reserves the right to refuse or cancel any order containing an abnormally high volume of items, as well as any order deemed suspicious, fraudulent, or unusual. This measure is intended to protect our customers and ensure the security of their transactions. In case of doubt, we reserve the right to take all necessary measures, including the suspension or cancellation of the order. As part of fraud prevention, AMENOLIA may require the customer to provide proof of their identity, address, and the payment method used. The order will be processed upon receipt of these documents. In the absence of these supporting documents, or if they are deemed non-compliant, the order may be canceled.

In certain circumstances, such as manufacturing problems, stock shortages, or defective product batches, AMENOLIA reserves the right to cancel an order without being held liable for any damages suffered by the customer.

If an order is canceled by us after payment has been made, AMENOLIA undertakes to fully refund the amounts paid, including delivery fees, as soon as possible and using the payment method used when the order was placed.

The provisions of this article shall not exclude or limit AMENOLIA's liability in the event of a breach of its legal or contractual obligations. In the event of an order cancellation initiated by AMENOLIA, the buyer will be fully refunded under the conditions set out below and retains the right to obtain compensation for the direct and foreseeable damage they can prove to have suffered as a result.

In the event of cancellation by AMENOLIA of an order already paid, the refund will occur no later than fourteen (14) days after notification of the cancellation, by the same payment method used for the initial transaction, unless the buyer expressly agrees to another method. Otherwise, the amounts due will automatically increase under the conditions of Article L.241-4 of the French Consumer Code.

Any supporting documents requested (ID, proof of address, proof of ownership of the payment method limited to the last four digits) are processed on the basis of AMENOLIA's legitimate interest in preventing payment fraud (Article 6.1.f of the GDPR). They are viewed only by authorized persons in the order department, deleted as soon as the doubt is removed and no later than 30 days, except in the case of ongoing procedures, and are securely deleted upon expiration of this period or upon confirmation of the order. AMENOLIA never asks for the full bank card number, the visual cryptogram, or the confidential code.

Article 5 – Order confirmation

AMENOLIA provides the buyer with an order confirmation by email. Any error, whether concerning the price, delivery address, or choice of pickup point, must be reported within 24 hours of receipt of this confirmation. Given preparation times, any request to modify the delivery address, pickup point, or order contents must be sent as soon as possible and, if possible, within twenty-four (24) hours of receipt of the confirmation, to sav@amenolia.com. After this period, AMENOLIA cannot guarantee that the request will be taken into account, as the order may already be in transit.

This timeframe is purely indicative and operational. It does not deprive the buyer of any of their rights: the right of withdrawal provided for in Article 13, the legal warranty of conformity, the legal warranty against hidden defects, and the right to obtain compensation for damage remain fully applicable within their respective legal timeframes.

Article 6 – Product information

The products listed on the website are offered in limited quantities; they are available until stocks last.

In the event of a technical problem on the website (pricing error) or a logistics problem (stock error), AMENOLIA reserves the right to refuse to process an order.

In the event of a stock shortage after the order is confirmed, AMENOLIA will refund the buyer the full amount paid in this regard, including the corresponding delivery fees, no later than fourteen (14) days after the date of contract termination, using the same payment method as that used when the order was placed. Otherwise, the amounts due will automatically increase under the conditions provided for in Article L.241-4 of the French Consumer Code.

Products are described and presented with the greatest possible accuracy. Photographs and illustrations are provided for illustrative purposes; slight variations in shade due to screen display settings do not constitute a lack of conformity. However, any error or omission regarding an essential characteristic of the product entitles the buyer to invoke the legal warranty of conformity under the conditions of Article 12, without prejudice to their right of withdrawal and their right to obtain compensation for the damage they can prove to have suffered.

Article 7 – Price

AMENOLIA reserves the right to change its prices at any time but undertakes to apply the rates in force indicated at the time the order is placed, subject to availability on that date.

Prices are indicated in euros. They do not include delivery fees, which are charged separately and indicated before the order is confirmed. Prices include the VAT applicable on the day the order is placed; any change in the applicable VAT rate will automatically be reflected in the price of the products in the online store.

If one or more taxes or contributions, particularly environmental ones, are created or modified, whether increased or decreased, this change may be reflected in the selling price of the products.

All-inclusive prices

Product prices are indicated in euros, all taxes included (TTC), excluding delivery fees. The total amount due, including delivery fees and any other potential fees, is summarized and brought to the buyer's attention before the final confirmation of their order, in accordance with Article L.221-5 of the French Consumer Code.

Price reduction announcements

In accordance with Article L.112-1-1 of the French Consumer Code, any announcement of a price reduction indicates, as a reference price, the lowest price actually charged by AMENOLIA to all consumers during the thirty (30) days preceding the application of the reduction. For products put on sale less than thirty days ago, the reference price is the lowest price charged since they were put on sale. In the event of successive and continuous reductions during the same commercial operation, the reference price remains the lowest price charged during the thirty days preceding the first reduction.

Manifest pricing error

In the event of a manifest and obvious pricing error, resulting notably from a technical failure and whose derisory nature could not have escaped the buyer, AMENOLIA reserves the right to cancel the order and fully refund the buyer, without the latter being entitled to delivery at the incorrect price. AMENOLIA will inform the buyer without delay.

Article 8 – Payment method

This is an order with a payment obligation, meaning that placing the order implies payment by the buyer. To pay for their order, the buyer has the choice of all payment methods made available by AMENOLIA and listed on the seller's website. The buyer guarantees the seller that they have any authorizations that may be necessary to use the payment method they choose when confirming the order form. AMENOLIA reserves the right to suspend all order processing and all deliveries in the event of a refusal of credit card payment authorization by the mandatory accredited organizations or in the event of non-payment. AMENOLIA reserves the right to refuse to carry out a delivery or to honor an order from a buyer who has not fully or partially paid a previous order or with whom a payment dispute is currently being processed.

The price is paid in full on the day the order is placed, according to the following methods:

  • Credit card
  • PayPal
  • Scalapay

Security

Payments are processed by an authorized payment service provider (Shopify Payments, PayPal Europe S.à r.l. et Cie S.C.A., Scalapay). Payment data is transmitted directly to this provider via an encrypted connection. AMENOLIA never has access to the full bank card number or the buyer's visual cryptogram and keeps no copy of it.

Strong authentication

In accordance with Directive (EU) 2015/2366, known as PSD2, credit card payments are subject to a strong customer authentication procedure implemented by the buyer's banking institution. Refusal of authentication results in the rejection of the transaction and the non-confirmation of the order.

No fees related to the payment method

In accordance with Article L.112-12 of the French Monetary and Financial Code, no additional fees are charged to the buyer for using a given payment method.

Retention of Title

The products remain the property of AMENOLIA until full payment has been received, in accordance with Article 2367 of the French Civil Code. However, the transfer of risk is governed by Article L.216-4 of the French Consumer Code, as restated in Article 10 of these terms: the risk of loss and damage is transferred to the buyer only when the buyer, or a third party designated by the buyer other than the carrier, takes physical possession of the goods.

Article 9 – Delivery

Except in cases of force majeure or during the online store closure periods clearly announced on the website's homepage, shipping times will be, subject to available stock, those indicated below. Shipping times are 1 to 3 business days (Monday to Friday) and may be extended to 4 business days during new collection launches, clearance periods, and sales. They begin on the order registration date indicated in the order confirmation email.

For any item offered for pre-order, a firm shipping deadline is indicated on the product page. When an order contains both available items and pre-order items, the buyer may, upon request sent to sav@amenolia.com, request the free cancellation of the part of their order relating to the pre-order items, with a corresponding refund within fourteen (14) days.

For deliveries in mainland France and Corsica, after the order preparation time indicated above:

Colissimo: 2 to 3 business days (after dispatch and depending on the destination country).

The times indicated above are in business days and constitute the average delivery times provided by the carriers. If AMENOLIA has not delivered the ordered product(s), the price of the order will be refunded in full within fourteen (14) days following the date of the order cancellation and the customer's notification.

Article 10 – Delivery Terms

Delivery means the transfer of physical possession of the goods to the consumer. The ordered products are delivered according to the terms and time specified above.

The products are delivered to the address indicated by the buyer on the order form; the buyer must ensure its accuracy. Any package returned to the seller due to an incorrect or incomplete address will be re-sent at the buyer's expense. At their request, the buyer may obtain the invoice sent to the billing address and not the delivery address by validating the option provided for this purpose on the order form. If the buyer is absent on the day of delivery, the delivery person will leave a delivery notice in the mailbox, which will allow the package to be collected at the place and time indicated.

AMENOLIA remains the buyer's sole point of contact in the event of loss, theft, delay, or damage to the package, and takes full responsibility for any recourse against the carrier.

It is recommended that the buyer, in their own interest and to facilitate the processing of their file, refuse the package if it is obviously damaged or open, or make precise and detailed reservations on the delivery slip, and then inform AMENOLIA at sav@amenolia.com by attaching photographs of the package and its contents. Otherwise, if the customer accepts their open or damaged package, it becomes difficult to determine when the damage was caused and by whom, which complicates the opening of a claim with the carrier. In the event that the carrier does not leave sufficient time for the buyer to effectively check the proper condition of the delivered products, the buyer has a period of 10 days to file a protest.

10.1 – Packaging of Shoes

Shoes are shipped in their original box, which is itself placed in a shipping pouch. The original box ensures the protection of the item during transport: it is designed to absorb shocks and pressure so that the shoes reach the customer intact. As such, it may show marks, creases, or deformations upon receipt. These transport-related marks do not constitute a product defect and cannot, on their own, give rise to an exchange, refund, or compensation. The right of withdrawal and the legal guarantee of conformity apply to the ordered item, namely the shoes themselves.

Article 11 – Delivery and Order Issues

To allow for rapid processing and useful recourse with the carrier, the buyer is recommended to report any delivery error or any apparent non-conformity within forty-eight (48) hours following the receipt of their order, by email to sav@amenolia.com, attaching their order number and photographs.

In the event of a justified claim, AMENOLIA will send the buyer, within forty-eight (48) business hours, a prepaid return label provided by AMENOLIA as well as a claim form.

Upon receipt of the returned package, AMENOLIA will, according to the claim form completed by the buyer, repair or replace the product within fourteen (14) days. When repair and replacement are impossible, or in the event of a stockout, the buyer may obtain a price reduction or the termination of the contract with a full refund of the item, under the conditions provided in Articles L.217-9 to L.217-14 of the French Consumer Code.

11.1 – Home Delivery Without Signature

For deliveries carried out without a signature option, the carrier considers the package delivered as soon as it is scanned as delivered to the address indicated by the buyer. This shipping method does not allow for hand delivery or acknowledgment of responsibility in the event of a later dispute.

When placing their order, the buyer freely chooses their delivery method. Home delivery without signature is offered at the most economical rate; however, it does not include hand delivery and does not allow the buyer to obtain personalized proof of delivery from the carrier. It is therefore recommended that the buyer who wishes to benefit from enhanced traceability opt for delivery with signature or for pickup at a relay point.

When the carrier declares a package as delivered and the buyer indicates they have not received it, the buyer informs AMENOLIA at sav@amenolia.com. AMENOLIA then opens an investigation with the carrier free of charge and keeps the buyer informed of its progress. The buyer is asked to first check the surroundings of their home, their mailbox, and their immediate neighbors, and, at AMENOLIA's request, to attest on their honor to the non-receipt of the package as well as to provide proof of identity (document kept only during the investigation).

In accordance with Article L.216-4 of the French Consumer Code, the risk of loss and damage is transferred to the buyer only when they take physical possession of the goods. It follows that, in the absence of proof of the effective delivery of the package to the buyer or a third party designated by them, AMENOLIA will, at the buyer's choice, re-ship the product or fully refund the order, including shipping costs, no later than thirty (30) days following the report.

AMENOLIA reserves the right to refuse a new shipment without signature to a buyer who has repeatedly declared the non-receipt of their packages, and to only offer them delivery methods with signature or at a relay point. In the event of proven fraud, AMENOLIA reserves the right to initiate any useful action.

To secure a delivery and guarantee handling in the event of a dispute, it is up to the buyer to opt, when placing their order, for a shipping method with signature or for pickup at a relay point.

11.2 – Defective Product and Missing Products at Delivery

In the event of receiving a defective or missing product at delivery, the customer is invited to contact our after-sales service by email at sav@amenolia.com as soon as possible (24 to 48 hours) after receiving their order. The customer must provide detailed information about the observed defect or the missing item, as well as any other requested proof (photographs, videos, etc.).

Any item returned without having been reported beforehand will be subject to a thorough verification. Prior reporting of the defect by email is recommended to speed up the processing of the file and to allow the sending of a prepaid return label.

AMENOLIA can only refuse to handle the claim if it establishes that the product does not present the alleged defect or that it results from a cause external to the product, notably from use not conforming to its purpose or to the maintenance instructions.

After verification, and if the defect is confirmed, AMENOLIA undertakes to provide a prepaid return slip as well as a claim form allowing the customer to return the product at no additional cost. The customer will then have the option of choosing between an exchange for an identical product (subject to availability) or a full refund of the amount paid.

The prepaid return label is issued for the only item concerned by the claim. It cannot be used for the return of other items from the order, whose return falls under the right of withdrawal provided in Article 13 and whose return costs remain the responsibility of the buyer.

When items not concerned by the claim are nevertheless returned using the prepaid label, AMENOLIA will process them under the right of withdrawal. The corresponding refund occurs under the conditions of Article 13, deducting the return shipping costs that the buyer would have borne if they had proceeded with a separate shipment. This deduction is determined based on the weight of only the items not concerned by the claim.

This deduction is applied only once per package, regardless of the number of items concerned, and corresponds to the direct cost of return within the meaning of Article L.221-23 of the French Consumer Code. The weight taken into account is that observed upon receipt, excluding the item that is the subject of the claim, whose return remains the responsibility of AMENOLIA.

AMENOLIA reserves the right to refuse to handle the claim if the returned product does not present the described defect, if after investigation no product is missing, or if the defect results from the customer's misuse of the product.

In the event of a delivery error, any product must be returned to the seller in its entirety and in its original packaging.

11.3 – Packages Not Collected at the Pickup Point

When a package is not collected by the buyer within the availability period indicated by the carrier, it is automatically returned to AMENOLIA.

AMENOLIA offers the buyer, at their choice: either a re-shipment of the package, the costs corresponding to the applicable delivery rate being their responsibility; or the refund of their order, including the initial shipping costs. In the absence of instructions from the buyer within fourteen (14) days, AMENOLIA will proceed with the refund.

In the event of a refund, it will cover the amount of their order, deducting the return shipping costs (5 euros), and will occur by the same payment method used during the order, no later than fourteen (14) days following the receipt of the returned package by AMENOLIA.

In the absence of payment for the re-shipment label within fourteen (14) days, AMENOLIA will proceed with the refund according to the terms above.

A credit note with a validity period of twelve (12) months may be offered to the buyer as an alternative to the refund. This credit note cannot be imposed on them: it can only be issued with their express agreement, in accordance with Article L.221-24 of the French Consumer Code.

11.4 – Packages Refused at Delivery

Any package refused at delivery without valid justification (preparation error, damaged product, etc.) will be treated as an unclaimed package (return to sender).

Article 12 – Product Warranty

12.1 – Legal Guarantee of Conformity

AMENOLIA guarantees the conformity of the sold goods to the contract, allowing the buyer to make a request under the legal guarantee of conformity provided in Articles L.217-3 et seq. of the French Consumer Code.

The buyer has a period of two (2) years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a non-conformity defect. During this period, the buyer is only required to establish the existence of the non-conformity defect and not the date of its appearance.

Non-conformity defects that appear within twenty-four (24) months from the delivery of the goods are presumed to have existed at the time of delivery, unless proven otherwise (Article L.217-7). This period is twelve (12) months for second-hand goods.

The buyer can choose between the repair and replacement of the goods, subject to the cost conditions provided in Article L.217-12 of the French Consumer Code. The bringing into conformity occurs free of charge, without major inconvenience for the buyer, and within thirty (30) days following their request (Articles L.217-10 and L.217-11).

In the event of repair of the goods, the buyer benefits from a six (6) month extension of the initial legal guarantee of conformity (Article L.217-13).

The buyer can obtain a price reduction while keeping the goods, or the termination of the contract with a full refund, notably if AMENOLIA refuses the bringing into conformity, if it occurs beyond thirty days, if it causes a major inconvenience for the buyer, or if the defect persists despite an attempt at bringing into conformity. The buyer is not required to previously request the repair or replacement of the goods when the non-conformity defect is sufficiently serious (Article L.217-14).

The legal guarantee of conformity applies independently of any commercial warranty that may be granted. No commercial warranty can reduce or set aside the legal guarantees (Articles L.217-21 and L.217-22 of the French Consumer Code).

The information box on legal guarantees, provided for in Article L.217-15 and the annex of Article D.211-2 of the French Consumer Code, appears in Article 12.3 of these terms.

12.2 – Legal Guarantee Against Hidden Defects

In accordance with Articles 1641 et seq. of the French Civil Code, the buyer can invoke the legal guarantee against hidden defects of the offered item. In this event, the buyer can choose between the termination of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code.

It is up to the buyer to establish that the defect existed before the delivery of the product and was not apparent at that date.

The products sold by the company AMENOLIA are covered by a warranty against manufacturing defects. This warranty does not cover:

  • normal wear and tear;
  • abusive or incorrect use;
  • damage occurring after improper handling or washing.

We recommend our customers to scrupulously follow the maintenance instructions provided with each product in order to preserve their quality.

For any question relating to our warranty policy, you can contact our customer service by email at sav@amenolia.com.

12.3 – Information box on legal guarantees

Consumers have a period of two years from the delivery of the goods to claim the legal guarantee of conformity in the event that a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

The legal guarantee of conformity obliges the trader, where applicable, to provide all necessary updates to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests that the goods be repaired but the seller insists on replacing them, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.

The consumer may obtain a price reduction while keeping the goods or terminate the contract and receive a full refund against return of the goods if:

  1. The trader refuses to repair or replace the goods;
  2. The repair or replacement of the goods takes place after a period of thirty days;
  3. The repair or replacement of the goods causes major inconvenience to the consumer, in particular if the consumer permanently bears the costs of collecting or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;
  4. The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In such cases, the consumer is not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee until the restored goods are delivered.

The rights mentioned above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who wilfully obstructs the enforcement of the legal guarantee of conformity may be subject to a civil fine of up to 300,000 euros, which may be increased to up to 10% of the average annual turnover (Article L.241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if they keep the goods or to a full refund against return of the goods.

Article 13 – Right of Withdrawal

In accordance with the provisions of the French Consumer Code, the buyer has 14 days from the date of delivery of their order to return any item that does not suit them and request a refund; return costs remain the responsibility of the buyer. The right of withdrawal applies fully to private sales, clearance sales, promotions, and sales.

The buyer may exercise their right of withdrawal either through the procedure below, by using the standard withdrawal form provided in the appendix hereto, or by any other unambiguous statement sent to sav@amenolia.com. AMENOLIA will acknowledge receipt of the withdrawal without delay on a durable medium.

How to Exercise Your Right of Withdrawal

  2. Select the relevant order (eligible for the 14-day period).

  4. Select the item or items you wish to return, then confirm your request.

13.1 – Conditions for Accepting Returns

A full refund requires that the item be returned in a condition that allows it to be resold:

  • It must be free from any traces, pet hair, or odors (makeup, cigarette smoke, perfume, perspiration, deodorant, etc.).
  • It must not have been worn, used, washed, or damaged, and must show no signs of soiling.
  • The item must retain all attached labels.
  • For shoes, the sole must be perfectly intact, with no signs of wear (try them on over a rug or smooth surface).

Some of our products are delivered with a protective pouch, which is considered an integral accessory and product protection. If an item is returned incompletely (for example, a bag without its pouch), the refund may only be partial: the value of the pouch will be deducted from the refund amount.

AMENOLIA assesses depreciation on a case-by-case basis. If it is minor or can be remedied by simple cleaning, the refund will be in full. If the condition of the item no longer allows it to be resold, the deduction may amount to the full price; AMENOLIA will then inform the buyer, provide photographs, and offer to resend the item at the buyer's expense.

13.2 – Items Not Eligible for Return

In accordance with Article L.221-28 of the French Consumer Code:

  • Earrings
  • Tights
  • Bodysuits
  • Perfumes and mists
  • Mystery boxes (personalized products)

13.3 – Liability and Refunds

The consumer is responsible for the products they return and for their condition upon receipt at our premises.

Your return and the initial delivery costs (in the event of a full return of the order) will be processed and refunded within 14 days of receipt of the products, provided no issues are identified.

The time it takes for the refund to appear in your bank account is generally 5 to 10 business days for a standard refund and 10 to 15 business days for a refund via PayPal.

For payments made with Scalapay, the refund will be applied directly to your installments. The remaining installments will be automatically adjusted according to the refunded amount.

If delivery was free because an order threshold was met and a partial withdrawal causes the value of the items kept to fall below that threshold, the delivery fee that would have applied (see the table in Article 9) will be deducted from the refund amount. The value of the items kept is calculated excluding delivery costs and after the application of any discount or promotional code. This deduction does not apply if the withdrawal covers the entire order.

13.4 – If These Conditions Are Not Met

The return may be refused. In such cases, our customer service team will contact you to arrange payment for a new label to collect your package.

The buyer may try on the products as they would in a store. They are only liable for handling other than that necessary to establish the nature, characteristics, and proper functioning of the goods.

If the returned item shows depreciation exceeding the handling necessary for trying it on, AMENOLIA may apply a deduction of up to the full price if the item becomes unsellable.

Article 14 – Force Majeure

Force majeure, within the meaning of Article 1218 of the French Civil Code, means any event beyond the debtor's control that could not reasonably have been foreseen at the time the contract was concluded and whose effects cannot be avoided by appropriate measures.

The party invoking force majeure must inform the other party without delay. Performance of obligations is then suspended for the duration of the impediment.

If the impediment is permanent, or if it lasts more than thirty (30) days, the contract is terminated by operation of law. AMENOLIA will then refund the buyer the full amount paid, including delivery costs, no later than fourteen (14) days after termination.

Force majeure may under no circumstances be invoked to prevent the buyer from exercising their right of withdrawal, to circumvent legal guarantees, or to avoid the obligation to refund amounts already paid.

Article 15 – Intellectual Property

All elements of the website, including texts, photographs, illustrations, visuals, logos, trademarks, designs and models, graphic charters, databases, and source codes, are protected by intellectual property law and remain the exclusive property of AMENOLIA or its partners.

AMENOLIA grants the buyer a strictly personal, non-exclusive, and non-transferable license to use the website, limited to viewing the website and reproducing the pages necessary to place and track their order. Any other use, including the reproduction, representation, adaptation, translation, extraction, or reuse of all or part of the content for commercial or non-commercial purposes, is prohibited without prior written authorization from AMENOLIA.

These provisions apply subject to the legal exceptions provided for in Article L.122-5 of the French Intellectual Property Code.

Any unauthorized reproduction constitutes an offense of counterfeiting punishable, pursuant to Articles L.335-2 and L.335-3 of the French Intellectual Property Code, by three years' imprisonment and a fine of 300,000 euros.

Article 16 – Language of the Contract

The general terms and conditions of sale are written in French. If they are translated, only the French text shall prevail in the event of a dispute.

In the event of any discrepancy between the French version and a translated version, the French version shall prevail, without this provision depriving the buyer of the protection provided by the mandatory provisions of the law of their country of habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008, known as Rome I.

Article 17 – Mediation and Dispute Resolution

17.1 – Preliminary Complaint to Customer Service

In the event of a dispute, the buyer is invited to first submit a written complaint to AMENOLIA's customer service team by email at sav@amenolia.com or by post to AMENOLIA - Service client, 404 chemin départemental 26, Quartier des Sableyes, 30400 Villeneuve-lès-Avignon. AMENOLIA undertakes to acknowledge receipt of any complaint within forty-eight (48) business hours and to provide a reasoned response within a maximum period of fifteen (15) business days.

17.2 – Consumer Mediation

In accordance with Articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code, the buyer may free of charge refer the matter to a consumer mediator to seek an amicable resolution of any dispute between them and AMENOLIA.

AMENOLIA has appointed the following mediator for this purpose:

CM2C — Consumer Mediation and Justice Conciliator Center
49 rue de Ponthieu, 75008 Paris
Telephone: 01 89 47 00 14
www.cm2c.net
litiges@cm2c.net

Recourse to mediation is free for the consumer. The mediator may only examine the dispute if the buyer can show that they have first attempted to resolve the dispute directly with AMENOLIA by submitting a written complaint, that their request is neither manifestly unfounded nor abusive, that the dispute has not previously been examined or is not currently being examined by another mediator or a court, and that the buyer submits their request within a maximum period of one (1) year from their written complaint to AMENOLIA, in accordance with Article L.612-2 of the French Consumer Code.

The parties remain free to accept or reject recourse to mediation as well as, where applicable, the solution proposed by the mediator. Recourse to mediation does not preclude the subsequent referral of the matter to the competent courts.

17.3 – Cross-Border Disputes

The European online dispute resolution platform, established by Regulation (EU) No 524/2013, permanently ceased operations on July 20, 2025, following the repeal of that Regulation by Regulation (EU) 2024/3228 of December 19, 2024.

Consumers residing in another Member State of the European Union, Norway, or Iceland may contact the European Consumer Centres Network (ECC-Net), and in particular the European Consumer Centre France, accessible at www.europe-consommateurs.eu, to obtain free assistance in reaching an amicable settlement of their dispute.

Article 18 – Applicable Law

These general terms and conditions of sale are subject to French law.

This choice may not deprive the consumer buyer residing in another State of the protection provided by the mandatory provisions of the law of their country of habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008, known as Rome I.

In the event of a dispute, the buyer should first contact AMENOLIA's customer service team at sav@amenolia.com to seek an amicable settlement, and then, where applicable, the consumer mediator appointed in Article 17.

If an amicable settlement is not reached, the buyer may, at their choice, in addition to one of the courts with territorial jurisdiction under the French Code of Civil Procedure, bring the matter before the court of the place where they resided at the time the contract was concluded or the damaging event occurred, in accordance with Article R.631-3 of the French Consumer Code.

A consumer buyer domiciled in another Member State of the European Union may only be brought before the courts of the Member State of their domicile and may, at their choice, bring the action before those courts or before the French courts, in accordance with Articles 17 to 19 of Regulation (EU) No 1215/2012.

In accordance with Article L.622-1 of the French Consumer Code, the buyer may also participate in a class action brought before the civil courts.

Article 19 – Promotional Codes, Store Credit, Gift Cards

Promotional codes are personal, cannot be combined with one another unless stated otherwise, are indivisible, and may not give rise to any cash refund. They are valid for the period indicated at the time of their issuance.

If a withdrawal covers an order paid for using a promotional code, the refund will cover the amounts actually paid by the buyer. If a partial withdrawal causes the order to no longer benefit from the threshold that entitled it to the promotion, the amount of the benefit may be deducted from the refund, up to its value.

Store credit issued with the buyer's express agreement is valid for twelve (12) months from the date of issuance and may be used in one or more installments across the entire website.

Gift cards are valid for twelve (12) months from the date of issuance, cannot be topped up, and may not be refunded in cash. In accordance with Article L.221-28 of the French Consumer Code, the purchase of a gift card entitles the buyer to the right of withdrawal under the general conditions of law until it has been used.

Article 20 – Ambassador Program

AMENOLIA offers certain customers the opportunity to participate in an ambassador program, which consists of receiving free items in exchange for publishing promotional content on their own social media networks.

Participation is optional and is based on application using the form provided by AMENOLIA. It is reserved for adults. Selection is at the sole discretion of AMENOLIA, and submitting an application does not entitle the applicant to any consideration.

Any participation is subject to a contract separate from these General Terms and Conditions, concluded and signed prior to any delivery of items. This contract specifies, in particular, the nature and value of the items delivered, the minimum number of expected posts and the publication deadline, the scope and duration of the authorization to use the content, prohibited content, as well as the conditions for the end of the collaboration and the return of the items.

20.1 – Nature of the relationship

Participation in the program does not create any relationship of subordination between AMENOLIA and the participant, nor any salaried employment relationship.

Although a minimum number of posts and an overall deadline may be agreed upon in the contract, the participant remains entirely free to choose the content, format, framing, location, and timing of each of their posts. AMENOLIA exercises no control or prior approval over the published content and only intervenes ex post facto in the sole event of a breach expressly provided for in the contract.

No monetary remuneration is due for this participation.

20.2 – Advertising transparency

The content published as part of the program constitutes advertising communications. In accordance with Law No. 2023-451 of June 9, 2023, it includes the mention "Advertising" or "Commercial Collaboration", in a clear, legible, and identifiable manner throughout the duration of its dissemination.

20.3 – Personal data

Content depicting identifiable persons constitutes personal data. Its processing is based on the consent of the data subject, which may be revoked at any time by writing to ambassadrices@amenolia.com. The terms of this processing, including retention periods and recipients, are detailed in AMENOLIA's Privacy Policy.

Article 21 – Miscellaneous provisions

If any provision of these General Terms and Conditions were declared null, deemed unwritten, or inapplicable, that provision would be deemed unwritten without affecting the validity of the other provisions, which would remain fully in force.

In accordance with Article L.213-1 of the Consumer Code, contracts concluded electronically relating to an amount equal to or greater than 120 euros are archived by AMENOLIA for a period of ten (10) years from delivery. The buyer may obtain a copy at any time simply by making a request sent to sav@amenolia.com.

AMENOLIA's customer service can be reached by email at sav@amenolia.com from Monday to Friday from 9 a.m. to 5 p.m., except on public holidays and during closing periods.

These general terms and conditions of sale were updated on October 15, 2026, and supersede and replace any previous version. They apply to any order placed from this date onward.
